In the below Terms of Use, Privacy Policy and Terms of Sale (collectively the “Legal Policies” or “Policies”), we use the term Nour By Jahan (as well as “We”, “Us” and “Our”) to refer to the brand Nour By Jahan, Swissgem SA and its affiliates.
The website https://www.nourbyjahan.com (the “Website”) and mobile applications related to Nour By Jahan (together the “Platforms”) are owned and operated by Nour By Jahan.

By using the Platforms, you (“You”, the “User”) guarantee that You have the legal capacity to accept and be bound by these Policies and signify your consent and agreement to these Policies, which are applicable regardless of the means or medium you (“You”, the “User”) use to access the Platforms. Use of the Platforms and Platform Documents
Nour By Jahan has created its various Platforms, including this Website, to provide information about its company and its products for your personal use and to allow you to contact Nour By Jahan.
Although considerable effort has been made to ensure that the visual representations of Nour By Jahan products displayed on the Platforms are representative of the color, design, style, etc. of the original products, slight variations, distortions and/or differences may appear with respect to the original product. This may be due for reasons that may include, but are not limited to, technical problems such as the configuration of your browser, monitor, computer or mobile device. Consequently, Nour By Jahan cannot be held responsible for apparent differences between the images of the products represented on the Platforms and the original products. We strongly advise you to visit one of our stores before making a purchase online.
Unless otherwise indicated, you must consider that everything you see or read on the Platforms, including but not limited to Nour By Jahan creations or products, images, photos, including any person represented in the photos, illustrations, icons, texts, video clips, music, written documents or other, (hereafter referred to as a “Nour By Jahan Document“) belongs to Nour By Jahan and is protected by law, including any law protecting copyrights, designs and trademarks, as well as under the provisions of international treaties and national laws around the world.
Actions that are strictly forbidden include, but are not limited to, the following: to sell, reproduce, distribute, communicate, modify, display, publicly perform, report or otherwise create derivative or second-hand works based on any Nour By Jahan Document or to use said Nour By Jahan Document in any manner whatsoever for public or commercial purposes. In addition, a Nour By Jahan Document may not be displayed or communicated on any other platform, in a networked computer environment or on any other digital platform, for any purpose whatsoever without the prior consent of Nour By Jahan.
In the event of a breach of any of these Terms of Use, your authorization to use a Nour By Jahan Document shall automatically terminate and all copies made of such Nour By Jahan Document shall be immediately destroyed. Any unauthorized use of a Nour By Jahan Document may violate copyright laws, trademark laws, laws on confidentiality and publicity, as well as regulations and statutes relating to communications.
Your submissions and unsolicited communications
This section deals with communications sent to Nour By Jahan. It does not concern the communication of personal information to Nour By Jahan in relation to customer requests, the use of services or the purchase of products by telephone or through the Platforms, which are governed by the Privacy Policy.
Any unsolicited communication or material you transmit to Nour By Jahan via the Platforms or through social media, email or otherwise, including but not limited to data, questions or answers, comments, suggestions or the like, will be treated as non-confidential and non-proprietary by Nour By Jahan. By sending communications to Nour By Jahan, you automatically grant Nour By Jahan a worldwide, royalty-free, perpetual, irrevocable and non-exclusive license to use, reproduce, modify, publish, edit, translate, distribute, perform and display such communications, alone or as part of other works, in any form, media or technology now known or hereafter developed, and the right to assign such rights to any person. All information you transmit may be used by Nour By Jahan and its affiliates for any purpose, including, but not limited to, reproduction, disclosure, transmission, publication, broadcast and posting, or developing, manufacturing and marketing products based on such information.
In addition, Nour By Jahan enjoys a worldwide reputation for both the design and manufacture of high-quality luxury goods. To this end, it has its own creative sources, including teams of highly skilled designers who design and perfect Nour By Jahan's creations. As a result, Nour By Jahan cannot agree or accept to be the recipient of unsolicited proposals for collaboration. Indeed, it is conceivable that Nour By Jahan is already working on similar ideas and/or creations.
Limitations of Liability
This section applies to Platforms and not to products that can be sold online or by phone through one of our local or regional markets.
Nour By Jahan strives to ensure that the information provided is accurate and complete. However, Nour By Jahan does not provide any guarantee, implicitly or explicitly, with respect to the Website or the Platforms, including, but not limited to, whether any Nour By Jahan Document is accurate, exhaustive or reliable, or that the use of said Nour By Jahan Document will not infringe the rights of third parties.
Nour By Jahan does not guarantee that the functional and/or technical aspects of the Platforms or any Nour By Jahan Documents are free of errors or that the Platforms, Nour By Jahan Documents or the servers that make them available are free of viruses or other harmful components. If the use of the Platforms or any Nour By Jahan Documents results in the need to repair or replace goods, materials, equipment, data or other elements, Nour By Jahan will not be responsible for these costs. Without limiting the foregoing, all materials provided to you on the Platforms are provided to you “AS IS” AND “AS AVAILABLE” AND, EXCEPT AS PROVIDED BY IMPERATIVE LEGAL PROVISIONS, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, COMMERCIAL VALUE, SATISFACTORY QUALITY, FITNESS FOR A SPECIFIC PURPOSE, REASONABLE CARE AND SKILL OR NON-INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS. Nour By Jahan and its suppliers make no warranty regarding any Document, software, text, download, graphic element or link from Nour By Jahan, nor any warranty as to the results expected from using the Platforms.
Unless mandatory legal provisions to the contrary exist, Nour By Jahan shall not be held liable for any direct or indirect damages, of any nature, cause, origin or consequence whatsoever, resulting from the use of the information available on the Platforms or in connection with the use of said information, or held liable for any loss of use, business interruption, loss of profits or data, regardless of the form of action, even if Nour By Jahan has been advised of the possibility of such damages.
Trademark notice
In general, all trademarks, logos and service marks (collectively the “Trademarks“) that appear on the Platforms are registered, unregistered or otherwise protected Trademarks of Nour By Jahan or are used under license to Nour By Jahan by third parties. The other Trademarks are proprietary marks and have been registered by their respective owners. Nothing contained on the Platforms should be construed as granting, implicitly or explicitly, any license or right to use any Trademark without the prior written permission of Nour By Jahan or the third party owner of the Trademark.
The misappropriation of any Trademark displayed on the Platforms, or of any other content on the Platforms, is strictly prohibited, except as otherwise provided herein.

Nour By Jahan does not authorize any link to any of its Platforms from a third party platform without its prior written permission.
Termination and suspension
Nour By Jahan may, without prejudice to its other rights, terminate or suspend your access and use of the Platforms, with or without notice, in the event of your breach of any of the provisions of this agreement, or in the event of a violation by you of the rights of Nour By Jahan, its affiliates or a third party.

These Terms and Conditions of Sale apply to all sales of Nour By Jahan products or services that you may order from SWISSGEM SA, on the Website and via any associated Platforms (collectively the “Sales Channels”) referring to these Terms and Conditions of Sale.
By placing an order, you agree to be bound by the Terms of Use and the Privacy Policy, the terms of which are incorporated into these Terms and Conditions of Sale.
Please note that before ordering products or services, you will be asked to accept these Terms and Conditions of Sale. If you do not accept these Terms and Conditions of Sale, you will not be able to order any products or services through the Sales Channels. Sales made through physical outlets (such as our shops) or through third parties (such as authorized resellers) are not subject to these Terms and Conditions of Sale
Return Policy
By placing an order, you agree to be bound by the Terms of Use and the Privacy Policy, the terms of which are incorporated into these Terms and Conditions of Sale.
You may return any only purchase without customized engraving or embossing for a refund or exchange, by clearly informing us of your intention to do so within fourteen (14) calendar days from the date of receipt by you of the products:

All returns must include the original sales recipe and be returned in original packaging.
You must include the product and all accessories, free items received as part of your order, the Service Guide, Warranty Card and all other documents in their original packaging;
Any product with signs of wear, damage, or alteration (including but not limited to re-sizing and engraving) or whose security tag, if any, has been removed cannot be accepted for return. You will be refunded for the accepted returned products and we will pay the cost of returning the Products by providing you with a Return Label.
All returns will be subjected by us to a rigorous Quality Control (QC) to ensure that the returned products comply with these quality requirements. If the products do not meet the QC standards, we will refuse the return, and the products will be returned to you. If the returned product meets QC standards, we will proceed with the applicable refund or exchange.
If you are returning a product to us because it is faulty, we will fully refund the price of the purchase.
Only the purchaser shall be entitled to a refund of the purchase price. A person who has received the product as a gift (i.e. the “Gift Recipient“) will not be entitled to receive a refund under any circumstances. If you are the Gift Recipient and wish to return a product, [please contact us to discuss your options].
In the event that you choose to send us the package, the Customer Relations Centre will send you a postage-paid return label by e-mail.
You must retain proof of return shipment, and we will not be liable if you are unable to provide such proof. Only merchandise received by the distribution centre of our Nour By Jahan e-boutique will be eligible for a refund or exchange.
Your refund will then be processed in the following 5 business days and be paid using the original method of payment. This may take up to 14 days from receipt of the jewellery, depending on your location and payment method.
Return to one of our Stores:
We also offer you the possibility to return your online purchase to the Nour By Jahan Store in London, Geneva or Riyadh, for an exchange, store credit or refund. You may return your online purchase without customization and whose security tag, if any, has not been removed within fourteen (14) calendar days from the date of receipt by you or within fourteen (14) days from the day you have sent us a declaration explicitly stating your decision to return the item. If you have exchanged the purchased product for another product of higher price you will be charged the difference. Gift recipients will be entitled to an exchange of equal value, with an original gift receipt only. Store credits may only be redeemed at one of our retail stores and not through an online purchase.
Non-refundable Items
Orders for products that have been somehow customized (including but not limited to bespoke orders) you cannot be cancelled and such products cannot be returned to us for exchange or refund. This includes products that have been engraved or embossed.
Order and shipping confirmation
We will send you an Order and Shipping Confirmation in writing (by e-mail or otherwise) when we ship your order. This Order and Dispatch Confirmation constitutes acceptance of your order by us and indicates the existence of a binding contract of sale.
Delivery
We will use reasonable efforts to ensure that delivery is made by the carrier within the estimated delivery time from the date of our written Order and Shipping Confirmation, unless your purchase is for a product or service that will require additional time for delivery as explained to you, for example, products or services that we customize or manufacture to your specifications.
When placing an order through the Sales Channels, you have the possibility to choose a particular delivery date proposed on the Sales Channels. The said particular delivery date remains subject to our confirmation.
When assessing your delivery time, please take into account the time required for payment approval, address verification, security checks and order processing. Please note that delivery is always subject to receipt of your full payment.
Shipping policy
We only accept orders for delivery to the countries identified during the Order Process. Please note that we do not ship to certain addresses, such as military zones, certain restricted areas, collection points (including, but not limited to, PickPost, MyPost24, etc.) or post office boxes.
Both worldwide delivery and in-store withdrawals are offered free of charge at certain locations. Please refer to the Platforms or call us on +41 22 810 20 20. We will notify you by email or phone when the product is ready for in-store pick-up.
If you order several products, we will only ship the order once all the products are available (there will be no partial delivery unless you have been informed otherwise).
Custom, Duties and Taxes
The customs office of your country may impose customs fees, import duties, taxes and other charges to your international order. These charges required for customs clearance are your responsibility unless otherwise noted.
